  • Session data, including the specific program selected and frequency of usage;

  • Your billing information, transaction and payment card information;

  • Inferences drawn from any of the information identified above to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

This personal information is required to provide our products and services to you. If you do not provide personal information we ask for, it may delay or prevent us from providing products and services to you.

We collect most of this personal information directly from you—in person, by telephone, or email and/or via our website. However, we may also collect information:

We do not knowingly collect data from or market to children under 18 years old. By using this Site, you represent that you are at least 18 years old. If we learn that we have collected personal information from an individual under the age of 18, we will take reasonable measures to promptly delete such data from our records. Promotional Communications

We may use your personal information to send you updates (by email, text message, telephone or post) about our products and services, including exclusive offers, promotions or new products and services.

We have a legitimate interest in processing your personal information for promotional purposes (see above “How and why we use your personal information”). This means we do not usually need your consent to send you promotional communications. However, where consent is needed, we will ask for this consent separately and clearly.

You have the right to opt out of receiving promotional communications at any time by:

  • using the ‘unsubscribe' link in emails or ‘STOP' number in texts; and/or

  • updating your marketing preferences on our website.

Who We Share Your Personal Information With

We routinely share personal information with:

  • Companies within the Ammortal group;

  • Third parties we use to help deliver our products and services to you, e.g., payment service providers, warehouses and delivery companies;

  • Other third parties we use to help us run our business, e.g., marketing agencies or website hosts;

  • Third parties approved by you, e.g., third party payment providers or order fulfillment service providers;

  • Data analytics services;

  • Cloud computing services;

  • Performance monitoring tools.

We only allow our service providers to handle your personal information if we are satisfied they take appropriate measures to protect your personal information. We may also share personal information with external auditors.

We may disclose and exchange information with law enforcement agencies and regulatory bodies to comply with our legal and regulatory obligations.

We may also need to share some personal information with other parties, such as potential buyers of some or all of our business or during a restructuring. Usually, information will be anonymised but this may not always be possible. The recipient of the information will be bound by confidentiality obligations.

Personal Information We Sold or Disclosed for a Business Purpose.

In the preceding 12 months, we have not sold or disclosed any personal information to third parties for a business purpose. However, we recognize the importance of transparency and providing you with clear information regarding your personal data and our practices. 

While we do not sell personal information, we may disclose your personal information to our clinical trial partners for the purpose of conducting clinical trials and/or user studies, but only under the following conditions:

  • Opt-In Requirement: Participation in clinical trials or user studies is entirely voluntary. We will only disclose your personal information if you explicitly opt-in to participate.

  • Additional Terms and Informed Consent: If you choose to participate in a clinical trial or user study, you will be provided with additional terms and conditions outlining the scope, purpose, and nature of the study. You will also be required to review and accept these terms and sign an informed consent form. This form will provide detailed information about the study, including potential risks, benefits, and how your personal information will be used and protected.

Any personal information disclosed to our clinical trial partners will be subject to strict data protection protocols and used solely for the purposes outlined in the informed consent form.

Where Your Personal Information is Held

Information may be held at our offices and those of our third party agencies, service providers, representatives and agents as described above (see above: “Who we share your personal information with”).

How Long Your Personal Information Will Be Kept

We will keep your personal information for as long as necessary to fulfill the purposes set forth in this Privacy Policy, unless a longer retention period is required or permitted by law. We will not keep your personal information for longer than necessary for the purposes for which it is processed. This will typically be for a period of 2-3 years following the last user activity. Thereafter, we will keep your personal information for as long as is necessary:

Right to Deletion

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

  • Delete your personal information from our records; and

  • Direct any service providers to delete your personal information from their records.

Please note that we may not delete your personal information if it is necessary to:

  • Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;

  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;

  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
